These terms apply to your use of the fertileapp.com website. Clinics that subscribe to Open Library or Personalized Portal also sign a separate service agreement, which governs those services.
1. About these terms
Fertileapp.com ("Fertileapp", "we", "us") operates fertileapp.com, including its demo booking page. By using the website, you agree to these terms. If you don't agree, please don't use the website.
If you use the website on behalf of a clinic or other organization, you confirm that you're authorized to act for it. If these terms conflict with a signed service agreement between your clinic and us, the service agreement applies.
2. Educational information, not medical advice
The website and our learning modules provide general educational information about fertility care. They don't replace advice from a qualified health professional, and they don't create a patient–provider relationship with us. Patients should follow the guidance of their own care team.
If you think you're having a medical emergency, call 911 or your local emergency number right away.
3. Plans and pricing
Prices on the website are listed in US dollars, per clinic location, per month. They're provided for information and may change. Pricing on the website isn't an offer to contract. Your clinic's final pricing, applicable taxes, billing terms, and service levels are set out in its order or service agreement.
4. Demo requests
When you request a demo, please give accurate information. Requesting a demo doesn't commit you or us to any purchase or agreement. We handle the information you provide as described in our Privacy Policy.
5. Acceptable use
When using the website, you agree not to:
- break any law or infringe anyone's rights;
- submit false information, impersonate someone, or send spam or automated requests through our forms;
- try to access systems or data you aren't authorized to access, or interfere with the website's security or operation;
- copy, scrape, or reuse the website's content or design in bulk, or use it to build a competing product.
6. Intellectual property
The website, including its text, learning module samples, product designs, illustrations, logos, and the Fertileapp.com name, belongs to us or our licensors and is protected by intellectual property laws. You may view and share links to the website for your own information and to evaluate our services. You may not use our name or logos without our written permission.
7. Third-party services
The website uses third-party services, such as Google Fonts, and may link to other websites. We don't control those services and aren't responsible for their content or practices.
8. Disclaimer
We work to keep the website accurate and available, but we provide it "as is" and "as available". To the fullest extent permitted by law, we make no warranties about the website, including that it will be error-free, uninterrupted, or suitable for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the website. Our total liability for any claim relating to the website is limited to CA$100. Nothing in these terms limits liability that can't be limited under applicable law. This section doesn't apply to services provided under a signed service agreement, which sets out its own terms.
10. Changes to these terms
We may update these terms from time to time. We'll post the updated version here with a new effective date. If you keep using the website after an update, the updated terms apply.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree that the courts of Ontario have exclusive jurisdiction over any dispute relating to these terms or the website.
